TouchYa
Terms & Conditions
1. Acceptance and eligibility
By using www.touchya.com, you agree to these website terms to the extent permitted by law. If you do not agree, do not use the website. You must have legal capacity to make a service arrangement or involve an authorized parent or guardian where appropriate. Website access does not establish eligibility for treatment.
2. Permitted and prohibited use
You may browse the site and contact TouchYa for lawful personal inquiries. Do not misuse contact channels, impersonate someone, send harmful or unlawful material, attempt unauthorized access, interfere with the website, or collect others' information without authorization.
3. Intellectual property
TouchYa branding, original website text, and original visual materials are protected by applicable intellectual property law. You may view and save reasonable excerpts for personal, noncommercial use with notices preserved. Other reproduction, commercial use, or redistribution requires permission from the relevant rights holder. Third-party names and materials remain their owners' property.
4. Inquiries and submissions
The site does not host public user submissions. You remain responsible for information sent by telephone, email, or WhatsApp and should not send confidential information belonging to another person without authority. We may use your message to answer your request and arrange services as described in the Privacy Policy; sending a message does not grant us a right to publish it.
5. Booking and service arrangements
An inquiry is not a confirmed appointment. Availability, suitability, location, prices, and any payment, cancellation, or package conditions must be confirmed directly before booking. These website terms do not invent a cancellation fee, refund restriction, or guaranteed home-visit availability. Separate agreed service terms and consent procedures may apply. Post-operative care must follow your surgeon's guidance.
6. External services
WhatsApp, Instagram, email services, and linked informational websites are independent providers. Their own terms apply when you use them. Links do not mean we control or guarantee their content, availability, privacy, or security.
7. Availability and changes
We may update services, content, or website features and may interrupt or discontinue website access. Information may become outdated. We do not guarantee continuous availability, but changes do not remove rights that applicable law or a confirmed service agreement gives you.
8. Disclaimer of warranties
To the extent permitted by law, this website and its general information are provided as available without a warranty of uninterrupted access, accuracy, completeness, fitness for a particular purpose, or freedom from technical errors. This does not exclude warranties or duties that cannot legally be excluded, or replace obligations relating to services actually provided.
9. Limitation of liability
To the extent permitted by law, TouchYa is not liable for indirect or consequential losses arising from website use, reliance on general website information, or independent external services. Nothing here excludes liability for fraud, intentional misconduct, negligence, personal injury, or other matters where exclusion is prohibited. Your nonwaivable consumer and statutory rights remain intact.
10. Suspension of access
We may restrict website access or communications that are unlawful, abusive, or threaten security, where permitted by law. Restrictions do not eliminate rights under an existing service agreement or applicable law.
11. Governing law
These terms are governed by the laws of the State of Florida, without overriding mandatory consumer or privacy protections that apply to you. No specific county, court venue, or mandatory arbitration process is imposed by these terms.
12. General provisions and contact
If a provision is unenforceable, the remaining provisions continue to apply where lawful. These terms and referenced policies describe the agreement for website use; separately agreed treatment or booking terms still apply. Updates are identified by the date above and apply prospectively, subject to law. Questions or permission requests may be sent to Yailema Valdes at [email protected] or (786) 795-2203.
